Welcome to the Independent Georgia Medicaid Provider Group community (hereafter referred to as “the Community”). By registering for a membership profile, participating in group activities, or accessing any private resources within the Community, you agree to comply with and be bound by the following Terms and Conditions. These terms are designed to ensure that our group remains a lawful, professional, and secure environment for all members.
1. Eligibility and Membership
1.1 Eligibility Criteria
Membership in the Community is restricted to healthcare providers, administrators, and authorized staff currently participating in or applying to the Georgia Medicaid program. By registering, you affirm that you meet these eligibility requirements.
1.2 Registration Information
You agree to provide accurate, current, and complete information during the registration process. It is your responsibility to update your information as necessary to ensure that it remains accurate and current. Failure to do so may result in the suspension or termination of your membership.
1.3 Membership Account
You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately if you become aware of any unauthorized use of your account.
2. Legal Compliance & Stark Law Adherence
2.1 Compliance with Laws
Members are required to conduct all professional activities within the Community in strict adherence to federal and state laws, regulations, and ethical guidelines. This includes compliance with the Stark Law (Physician Self-Referral Law), the Anti-Kickback Statute, and other relevant healthcare laws.
2.2 Stark Law & Anti-Kickback Statute
Members must ensure that any professional connections, collaborations, or interactions made through the Community comply with the Stark Law (Physician Self-Referral Law) and the Federal Anti-Kickback Statute. Under no circumstances shall members use the platform to solicit or arrange for referrals in exchange for remuneration, either directly or indirectly.
2.3 No Improper Referrals
The Community is intended solely for information sharing, networking, and advocacy. Members shall not use the platform for making or facilitating improper referrals or for any other activity that violates the Stark Law or Anti-Kickback Statute.
3. Prohibition on Fee-Schedule Sharing (Anti-Trust)
3.1 Anti-Trust Compliance
To protect both the interests of the Community and individual members, we enforce strict compliance with federal anti-trust laws. Members shall not engage in, promote, or facilitate activities that may result in illegal price-fixing, collective bargaining, or any form of coordinated pricing activity.
3.2 Confidentiality of Fee Schedules
Members are strictly prohibited from sharing, posting, or comparing specific private fee schedules, negotiated rates, or contractual terms from Care Management Organizations (CMOs) or other payers with other members. Discussions or disclosures of any non-public, proprietary financial information are prohibited.
3.3 General Discussions
While members may engage in discussions about general policy changes, publicly available reimbursement rates, or state Medicaid rates, any specific private contract terms, negotiated rates, or fee schedules must remain confidential.
4. Community Conduct and Respect
4.1 Professionalism
As a member of this professional community, you agree to maintain respectful, professional, and relevant communication. All posts, comments, and interactions in the membership portal, forums, or comment sections must reflect the professional standards expected within the healthcare industry.
4.2 Prohibited Content
The following conduct is strictly prohibited within the Community:
- Harassment, bullying, or discriminatory behavior towards any member or individual.
- Posting or sharing defamatory, false, or misleading statements about other healthcare providers, administrators, state officials, or entities.
- Sharing protected health information (PHI) in violation of HIPAA or other privacy regulations.
- Any form of hate speech, violent threats, or inflammatory political discussions unrelated to the Community’s purpose.
4.3 Conflict Resolution
Members agree to address any conflicts or disagreements with fellow members or administrators privately, using appropriate and professional communication channels. Public forum posts are not the appropriate platform for conflict resolution.
5. Intellectual Property and Non-Disclosure
5.1 Proprietary Materials
Materials provided by [Your Group Name], including but not limited to legal summaries, policy briefings, strategic guides, and educational resources, are the intellectual property of the Community and are provided for the internal use of members only.
5.2 Non-Disclosure Agreement
You agree not to redistribute, publish, or sell any proprietary resources, content, or materials from the Community to third parties, including but not limited to CMOs, non-member providers, or the general public, without prior express written consent from [Your Group Name].
6. Limitation of Liability
6.1 No Legal, Financial, or Medical Advice
The information provided within the Community, including resources, discussions, and materials, is for informational purposes only. The Community does not offer legal, financial, or medical advice, and any information shared within the platform is not to be considered as such.
6.2 No Guarantee of Outcomes
We do not guarantee specific outcomes related to Medicaid reimbursement, contract negotiations, or any other professional activities. Each member is responsible for consulting their own legal counsel, financial advisor, or other relevant professional to address specific needs or concerns related to their practice.
6.3 Limitation of Liability
To the fullest extent permitted by law, [Your Group Name] and its affiliates are not responsible for any direct, indirect, incidental, or consequential damages arising from your use or reliance on the Community’s resources, content, or services.
7. Termination of Membership
7.1 Violation of Terms
We reserve the right to suspend or terminate your membership at our sole discretion for any violation of these Terms and Conditions, including but not limited to violations of legal compliance (Stark Law, Anti-Kickback Statute), the anti-trust provisions, and the standards of community conduct.
7.2 Termination Process
